One of the biggest obstacles in obtaining a divorce is the division of property. Typically, one of three issues is at the heart of the matter: classification of property or debts, asset valuation issues and hidden assets.
Classification of Property: Classification issues often revolve around whether the property should be classified as yours, theirs or marital property. Matters become more complex when an asset starts as yours or theirs, but may also become marital property. For example, a house was yours, but marital money went in for upkeep and maintenance, and perhaps some of the mortgage payments.
